I still remain your Senator – Isaac Alfa
The Senator representing Kogi East Senatorial District, Air Marshal (Rtd) Isaac Alfa, has urged the people of Kogi East to remain undisturbed by the judgement of the Appeal Court, adding that he still remains in office as their Senator.
Senator Alfa was reacting to the misinformation and rumours in some quarters that he may have been sacked by the Court of Appeal.
In a statement obtained from his office on Thursday, the lawmaker said it was necessary to address the public on the general principles of the judgement given by a Court of Appeal sitting in Abuja on Wednesday, on a pre-election matter between him and his opponent, Senator Attai Aidoko
According to Senator Alfa, a lot of persons who couldn’t make it to the court premises where the appellate court decided the case would be in the dark, if issues were not placed in their right perspectives.
He expressed dissatisfaction over the handling of the Appeal Court proceedings, adding that it was unethical for some Judges to be involved in acts capable of undermining the rule of law.
He explained that, what was not canvased for, in the originating summon or appellant’s brief and was not also mentioned at the trial court suddenly found its way into the judgement proper; even as he averred that the Presiding Judge refused to read the full judgement.
“They abandoned the judgement they have been writing for 3 weeks and all of a sudden, they came up with a different thing entirely, other than the appellant prayers”, he said.
He stressed that “the judgement was changed overnight and as such, it was not possible for them to give reasons for their judgement.
“We raised so many preliminary objections but they said our objections were not granted, and that the appeal succeeded.
“Even the Lawyer to my opponent was confused and asked which prayers were they granting, and they replied that until the full judgement comes out then he would know.
“And what was the appeal? The prayer of the Appeal was for the case to be returned to the Federal High Court for a fresh trial, wherefore, Aidoko would have the opportunity of inviting more witnesses in the suit”.
Senator Alfa said he started losing confidence in the whole process when the first panel set up to hear the appeal was disbanded by the President of Court of Appeal, for reasons best known to her.
He disclosed that another panel set up was also disbanded by the President of court appeal, until she finally got the type of panel she wanted, the third panel which was coming from Sokoto state to hear the appeal.
“The President of Court of Appeal had interfered so much that, this is the 3rd panel she would be setting up to for the appeal ” , he added.
Senator Alfa also disclosed in the statement that the judgement was hurriedly written in Sokoto and was read summarily, without prejudice to the prayers canvased for, by the Appellant himself.
He, however, added that the judgement has been appealed against and also an application for a stay of execution entered at the Supreme Court of Nigeria.
“As far as we are concerned, we have absolute confidence in the Supreme Court, because, the judgement at the Federal High Court was very sound and clear.
“The trial court discovered that the result sheets presented by Aidoko and PDP emanated from Kogi Central and not Kogi East which was in contention.
“The Judge in his sense of fairness, gave Aidoko the opportunity to go and bring the authentic result sheets. Aidoko came back and sworn to an affidavit that the results of Kogi Central presented by PDP was the authentic”, Alfa explained.
The Senator who recently led a debate for the inclusion of Kogi as oil producing state, therefore urged his constituents and teeming supporters to remain calm as no one, no matter how highly connected to Judges, can lay ambush to take away the mandate that the people willingly gave to him.
He said, “I still remain your Senator and will continue to fight for you”, adding that, Aidoko was only being jealous of the progress he (Alfa) has made at the senate in his 2 months of membership, the record which he said surpassed the wasted years of Aidoko at the National Assembly.
It could be recalled that Senator Isaac Alfa was sworn in, 2 months ago, after he defeated other contestants in a rerun election in Kogi East Senatorial District.
He first contested the primaries of the People’s Democratic Party (PDP) with Senator Attai Aidoko and others in 2014 and won overwhelmingly.
The PDP, however ,submitted Aidoko’s name for the general election and Senator Alfa approached the Federal High Court; even as Aidoko lost the general election to the then incumbent, Senator Abdulraman Abubakar of the All Progressive Congress (APC).
Not satisfied with the outcome of the election, Attai Aidoko instituted a case against the APC candidate at the election Tribunal and got judgement, that the election should be rerun.
Meanwhile, Senator Alfa also got the judgement of the Federal High Court, where he was declared the authentic candidate of the PDP at the 2014 primaries and was made to contest the scheduled rerun poll.
Alfa, therefore, participated in the rerun and defeated candidates from the other parties and was subsequently sworn in as Senator; and Aidoko instituted an appeal against the judgement of the trial court which nullified his candidature.
